NHS Constitution updated to include fundamental standards

The updates are designed to reflect current policy and make the Constitution a more practical document. They come after recommendations from Sir Robert Francis after his inquiry into the failings at Mid-Staffordshire, which include prioritising patients, protecting patients from avoidable harm, providing assistance that patients need and ensuring staff compliance with guidance.

The key areas that have been updated are: ‘standards of care’, which ensures the NHS never falls below the fundamental standards; ‘physical and mental health’, which aims to close the gap between physical and mental health treatments in the NHS and makes it clear that both are equally important; and a ‘duty of candour’, which is designed to promote a culture of openness within the NHS.

Sir Robert Francis said: “The Constitution is an immensely useful tool not only for patients but for NHS staff at all levels. So I look forward to it being fully integrated into everything the NHS does. It is important not only that everyone is familiar with the rights and responsibilities in the Constitution, but that they are a reality for everyone who offers or receives healthcare.”
