Cost of clinical negligence claims ‘spiralling’

NHS Confederation members have called for action to address the spiralling cost of clinical negligence claims in England.

NHS leaders met recently to discuss the need to redress current imbalances, welcoming the NHS Confederation’s work with the Medical Protection Society (MPS) to bring about change.

It comes as figures reveal the NHS in England spent £1.7 billion on clinical negligence claims last year alone.

As well as the financial costs, there are indirect costs which are harder to quantify, the NHS Confederation said.

GPs have told MPs that the fear of being sued has led them to order unnecessary tests and investigations.

The Civil Liability Bill, unveiled in the Queen’s Speech, presents an opportunity to change the legalisation that plays a significant part in driving the claims process.

Simon Kayll, chief executive of the MPS, said three main areas need to be addressed: improving patient safety; understanding the drivers of claims; and legal reform.
